Official Rules
CONTEST PERIOD
The Bausch + Lomb 75th Anniversary Sweepstakes (the "Contest") begins on February 8, 2010 at 12:01 AM EST, and closes on December 31, 2010 at 11:59 PM EST or once the 200,000th entry is assigned, whichever is earlier (“Contest Period”). The sole determinant of time for this Contest will be the Sponsor’s computer servers.
ELIGIBILITY
Entrants must be residents of Canada who have reached the age of majority in their province or territory of residence at the time of entry. Entrants must provide their own unique, valid and actively monitored email address to enter the contest, and otherwise complete the entry form, and read and agree to abide and be bound by these Office Rules. Employees, officers and directors (and members of their immediate families and/or the same household) of Bausch + Lomb Canada ("Sponsor"), its respective affiliates (including, without limitation, its parent, sister and subsidiary companies), and its advertising and promotional agencies, and the judging organization are not eligible to enter the Contest. For these Official Rules, "immediate family" means mother, father, sister, brother, son and daughter and spouse, including common law spouse, regardless of where they reside. Groups, clubs, organizations, businesses and commercial and non-commercial entities cannot participate.
HOW TO ENTER - NO PURCHASE NECESSARY
During the Contest Period, there are three (3) ways to enter:
1 - UPC from Bausch + Lomb Purchased Products & Survey - Go to the 75th Anniversary Sweepstakes Contest page at http://anniversary.bausch.ca and complete the entry form with your full name, full mailing address, daytime telephone number, day, month and year of birth, and a valid and actively monitored email address.; (2) read and accept these Official Rules; (3) select no if you wish to opt- out of communications with Bausch + Lomb Canada Inc.; (4) provide a UPC code from any purchased Bausch + Lomb product package by typing in the 12-digit number appearing at the bottom of the UPC barcode; and (5) complete the survey. You will then be randomly assigned ten (10) unique numbers for the draw between 1 and 4,000,000 inclusive, which will be recorded electronically as according to your entry information. Each unique number is an “Entry” in the draw.

2 - UPC from Bausch + Lomb Trial Products& Survey - Go to the 75th Anniversary Sweepstakes Contest page at http://anniversary.bausch.ca and complete the entry form with your full name, full mailing address, daytime telephone number, day, month and year of birth, and a valid and actively monitored email address.; (2) read and accept these Official Rules; (3) select no if you wish to opt- out of communications with Bausch + Lomb Canada Inc.; (4) provide a UPC code from any Bausch + Lomb free trial product package by typing in the 12-digit number appearing at the bottom of the UPC barcode; and (5) complete the survey. You will then be randomly assigned one (1) unique number for the draw between 1 and 4,000,000 inclusive, which will be recorded electronically as according to your entry information. Each unique number is an “Entry” in the draw. If you have entered by this mode, you may earn nine (9) additional entries by returning to the contest site with a UPC code from a purchased package of Bausch + Lomb Contact lenses or by mailing, in a postage-paid envelop, a 500 word description of how contact lenses can improve your quality of life, along with a completed entry form which will be available on http://anniversary.bausch.ca, to Bausch+Lomb Contest, 300 Coxwell Ave. P.O. Box 22563, Toronto Ontario M4L 3W7. Your description must be received by January 5, 2011. Proof of mailing (for example, postmarks, or registered mail etc.) does not constitute proof of receipt.
OR
3 - Alternate Mode: Mail-in Entry - During the Contest Period, print and complete an entry form available at the Contest page at http://anniversary.bausch.ca download and complete the form with your full name, full mailing address, daytime telephone number, day, month and year of birth, and a valid and actively monitored email address.; and in a postage-paid envelope mail it, along with a 25 word description of how you would celebrate Bausch + Lomb’s 75th Anniversary with $75,000 to Bausch+Lomb Contest, 300 Coxwell Ave. P.O. Box 22563, Toronto Ontario M4L 3W7. Mail-in Entries must be received by January 5, 2011. Proof of mailing (for example, postmarks, or registered mail etc.) does not constitute proof of receipt. You will be randomly assigned one (1) unique number between 1 and 4,000,000 inclusive for the draw, which will be recorded electronically as according to your entry information. Each unique number is an “Entry” in the draw. If you have entered by this mode, you may earn nine (9) additional entries by mailing, in the same postage-paid envelop, a 500 word description of how contact lenses can improve your quality of life.
Each entry will correspond to a unique number between 1 and 4,000,000 inclusive - no two entries correspond to the same number. If the number assigning system assigns the same number to more than one entry, the Sponsor may, in its sole and absolute discretion, re-assign all entries a new and unique number, and hold a draw at a later time after the re-assignment, which draw shall be subject to the same odds as set out herein (namely, each entry will have a 1 in 4,000,000 chance to win).
LIMIT: A maximum of ten (10) entries per person and per household. Participants who attempt to earn more than ten (10) entries will be disqualified. Participants may only use one email address to participate in the Contest. Entry material/data that has been tampered with or altered is prohibited and will be disqualified, including, without limitation, entries generated by script, macro, robotic, programmed, or any other automated means. Entries that are late, lost, stolen, illegible, contain false information, damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular, that have been submitted through illicit means or do not conform with or satisfy any or all of the conditions set out in the Official Rules will be disqualified. All entries and prize claims become the property of the Sponsor.
PRIZES
Each entry has a 1 in 4,000,000 chance to win $75,000 (the “Prize”) regardless of the number of entries received.
A random draw will take place on or around January 24, 2011 and one winning number will be randomly drawn by an independent judging organization from the pool of numbers between 1 and 4,000,000 inclusive. If the number assigned to an entry exactly matches the randomly selected winning number, the corresponding entrant is the potential winner of the prize and may make a “Prize Claim”. If the randomly selected winning number drawn does not match a number assigned to any entry, the prize will be unclaimed and not awarded.
Prize Claim is subject to winner confirmation, and prize will only be awarded to confirmed winner. See “Winner Confirmation” below for requirements to be confirmed a winner.
By submitting a Prize Claim, you are deemed to declare that you have fully complied with these Official Rules. Prizes are not transferable and must be accepted as awarded with no substitutions in cash or otherwise, except at Sponsor's sole and absolute discretion. Sponsor reserves the right, in its sole and absolute discretion, and for any reason whatsoever, to substitute a prize of equal or greater value, without liability. No correspondence will be entered into except with potential winners. Entry materials and Prize Claims become property of Sponsor and will not be returned.
WINNER CONFIRMATION
To be confirmed a winner, potential winner will be required to:
- Respond to a voicemail/email message to arrange a time to speak in person;
- correctly answer a time-limited mathematical skill-testing question to be administered by telephone at pre-arranged, mutually convenient time, without assistance of any kind, whether mechanical or otherwise. If a selected entrant cannot be reached within ten (10) days from the first attempted contact then the entry is null and void;
- be in full compliance with these Official Rules; and,
- complete a declaration of compliance with these Official Rules, and Publicity Release form (“Declaration and Release Form”).
No correspondence will be entered into except with potential winners. If potential winner is not confirmed a winner, the prize will not be awarded, and will remain unclaimed.
RELEASES, ETC.
By completing and returning the Online Declaration and Release Form, and accepting the Prize, the Winner:
(i) releases and holds harmless, Sponsor, its advertising and promotional agencies, suppliers of the Prize and/or materials related to the Contest, the judging organization, the affiliates of the foregoing (including, without limitation, parent, sister and subsidiary companies),, and all of their respective officers, directors, shareholders, employees, representatives, agents, successors and assigns (collectively, the "Releasees") from any damage, loss or liability arising from, related or connected to the Contest or a prize, including as set out below in the LIMITATION OF LIABILITY section;(ii) confirms compliance with the Official Rules;
(iii) acknowledges that the Prize must be accepted as awarded and cannot be substituted or transferred, except in the Sponsor’s sole discretion; and,
(iv) consents to the use of his/her name, address (city and province), photographs, image, statements regarding the Contest or the Prize and/or voice, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor with respect to the Contest in any media whatsoever.
LIMITATION OF LIABILITY
The Releasees do not assume any responsibility and the entrant releases the Releasees from any and all claims, actions, damages, demands and liabilities of whatever nature or kind arising out of, or in connection with the entrant’s participation or attempted participation in the Contest, including, without limitation the selection and confirmation of a winner, the administration of the Contest and the arranging, awarding and use of the Prize. Without limiting the generality of the forgoing, the Releasees are not responsible for (i) the incorrect or inaccurate capture of entry information; (ii) late, lost, stolen, illegible, damaged, misdirected, mutilated, garbled or incomplete entries or entries that are altered or otherwise irregular, contain false information, have been submitted through illicit means or do not conform with or satisfy any or all of the conditions of the Official Rules, whether caused by the Sponsor, participant, traffic congestion on the Internet or at any website, or howsoever else arising; (iii) any loss, damage, or claims caused by, or in anyway related to the awarded prize or the Contest itself; (iv) any failure of the website during the Contest Period, including, without limitation, any problems, human or technical, printing errors, lost, delayed, garbled data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or computer lines, technical malfunctions of any computer on-line systems, servers, access providers, computer equipment, hardware, software, servers, providers, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including, without limitation, any injury or damage to an entrant’s or any other person's computer related to or resulting from participating in or downloading any material connected to the Contest, all of which may affect a person’s ability to participate in the Contest; (v) any limits on a participant’s ability to participate in the Contest, including, without limitation, downloading any information necessary to participate in the Contest; (vi) any errors, omissions, incorrect or inaccurate information in any Contest-related materials, including, without limitation, printing or advertising errors or the failure of or problems with any equipment or programming associated with or used in the Contest howsoever caused; (vii) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer "hackers" or otherwise or (viii) any claims regarding the accepting, arranging, awarding or use of a prize.
CONTEST RULES AND SPORTSMANLIKE CONDUCT
By participating in the Contest, participants acknowledge and agree: (a) to read and abide by these Official Rules and all decisions of the Sponsor; (b) to not undermine or attempt to undermine the legitimate operation of the Contest by cheating, hacking, deception, or engaging in any other un-sportsmanlike or unfair practices or to annoy, abuse, threaten or harass Sponsor, Sponsor's agencies and representatives, or other participants in the Contest; (c) that all decisions of the Sponsor are final and binding in all matters relating to this Contest; and (d) if they are selected as a potential winner, to have their names, addresses (city and province) and likenesses published at Sponsor's sole discretion, without further compensation. Participants who have not complied with these Official Rules are subject to disqualification. Sponsor reserves the right in its sole and absolute discretion to prohibit an individual from participating in the Contest or claiming a prize if it finds or believes such individual is not in full compliance with these Rules, including this section.
TERMINATION OF CONTEST
Subject to obtaining the approval of the Régie des alcools, des courses et des jeux for Quebec, Sponsor reserves the right, in its sole discretion, to terminate or modify this Contest, in whole or in part, at any time, without notice and without liability, should any factor interfere with its proper conduct as contemplated by these Rules. Without limiting the generality of the foregoing, if through fraud, unauthorized human intervention, computer virus, bugs, tampering, human or technical failures, error in production or distribution, more prizes are claimed than intended by these Contest Rules, in such event, at Sponsor's sole and absolute discretion, the Sponsor may re-assign a new and unique number to all entries received on or before the date the contest was terminated, and hold a draw at a later time after the reassignment, which draw shall be subject to the same odds as set out herein (namely, each entry will have a 1 in 4,000,000 chance to win).
GENERAL
Contest is void where prohibited and subject to all applicable federal, provincial and municipal laws.
DISPUTE REGARDING IDENTITY OF PARTICIPANT
In the event of a dispute regarding the identity of the person participating in the contest, the participant will be deemed to be the "authorized account holder" of the e-mail address at the time of participation, provided that individual meets all eligibility criteria set forth in the Eligibility section of these Official Rules. "Authorized account holder" shall mean the natural person assigned to an e-mail address by an Internet Access provider, on-line service provider, or other organization responsible for assigning email addresses for the domains associated with the submitted e-mail address. If the name of the authorized account holder does not accord with the full name on the entry form, the entry may be disqualified at the Sponsor’s sole and absolute discretion.
PRIVACY
All personally identifiable information collected on the online entry form is referred to as "Personal Information". By entering the Contest, you consent and agree to the collection and use of your Personal Information for the purposes of administering the Contest. With your consent, obtained on the entry form, Sponsor may retain your Personal Contact Information (name, mailing address, email address and telephone number) and use it to send you information, newsletters and offers from Sponsor and its affiliated companies. If at any time you wish to stop receiving such information, please Contact the Bausch + Lomb privacy officer and ask your name to be removed from our contact list. QUEBEC RESIDENTS
Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

Box 22563, Toronto Ontario M4L 3W7. Official Rules will be posted on-line during the Contest Period at http://anniversary.bausch.ca .
RULES GOVERN
In the event of any discrepancy or inconsistency between the Official Rules and disclosures or other statements contained in any Contest related materials, including, but not limited to, the Contest entry form, the Official Rules shall prevail, govern and control.
